What is the Consent Decree?

The Consent Decree is a document that outlines the reforms the NPD must make to address the Department of Justice’s (“DOJ”) findings.  It can be accessed HERE.

Why is there a Consent Decree?

The Consent Decree was created in response to the DOJ’s 2014 findings that NPD officers have engaged in a pattern or practice of unconstitutional policing, including theft by officers, unlawful stops and arrests, excessive use of force, and retaliation against individuals who exercise their rights under the First Amendment.

Why is there an Independent Monitor?

The Independent Monitor is responsible for overseeing the implementation of the Consent Decree that was negotiated by the City of Newark, the NPD, and the DOJ (“the Parties”).

Who is the Independent Monitor? 

On May 5, 2016, Peter Harvey was appointed by the Court as the Independent Monitor.  Mr. Harvey served as Attorney General for the State of New Jersey during the time that the New Jersey State Police (“NJSP”) was under a federal consent decree between the State of New Jersey and the DOJ.  In this role, he assisted the NJSP in achieving full compliance with all components of the Consent Decree.

How can I stay informed?

To keep the public informed of the NPD’s progress, the Independent Monitor and Monitoring Team will issue quarterly written reports and hold public meetings to discuss these reports.   All upcoming community meetings will be listed HERE.
